Right to withdraw from the purchase and sale agreement, product exchange and return policy
1. Right to withdraw from the purchase and sale agreement:
1.1. The Buyer has a right to declare a withdraw from the purchase and sale agreement without a reason within 14 (fourteen) days by notifying the giftforyou.shop (hereinafter referred to as Seller). The Buyer may not exercise this right, if he has concluded one of the contracts listed in Article 6.22810 (2) of the Civil Code of the Republic of Lithuania.
1.2. The Buyer notifies about the withdrawal from the purchase and sale agreement by filling in the exemplary contract withdrawal form and sending it by email firstname.lastname@example.org. After receiving the Buyer's message, the Seller immediately send an acknowledgment of receipt.
1.3. A 14 (fourteen) day period for exercising the right of withdrawal from the purchase and sale agreement is calculated from the day when a Buyer or a person designated by him receives the ordered product.
2. Exchange and return policy for good quality product
2.1. The Buyer has the right to replace purchased products with analogous products having different dimensions, shape, color, model or completeness within 14 (fourteen) days from the day of delivery. If a price difference appears when changing the products, the Buyer must pay for the Seller according to recalculated prices. Notification of Buyer's wish to exercise the right provided in this clause of Policy with specified returned products has to be sent by email email@example.com
2.2. If the Buyer does not like the shape, size, color, model or completeness of purchased products, the products are replaced and returned in accordance with the Government of the Republic of Lithuania July 22, 2014 resolution No. 738 approved "Retail rules". Within 14 days, the Buyer has the right to replace and return any item which is not listed below:
• tobacco and tobacco products;
• perfumery, cosmetic and toilet preparations;
• photography and cinematography products;
• printed books, reproductions and other articles of the printing industry;
• carpeting, except carpets and rugs;
• knitted men, boys, women or girls’ underwear;
• baby clothes;
• tights, socks, anklets and other similar articles;
• sewn men, boys, women or girls’ underwear, nightdresses, pyjamas and other similar articles;
• bras, waistcoats, corsets and other similar articles;
• pearls, gemstones, precious metals and other similar articles (excluding imitation jewelry);
• machinery and mechanical equipment;
• electrical machinery and equipment, sound recorders and reproducers, and TV video and sound recorders and reproducers;
• road transport measures;
• ships, boats and floating devices;
• optical, photographic, cinematographic, measurement, control, medical or surgical devices and apparatus;
• music instruments;
• weapons and ammunition;
• furniture, bedding, lighting;
• toys, games (except sports and fishing tackle);
• works of art, collectibles and antiques;
• plants, animals and food of appropriate quality;
• weighted and measured products that have been specially prepared, cut and etc. according to request of the Buyer.
2.3. Upon receipt of the products, the Seller commits to replace them with the same products only in the shape, size, color, pattern or completeness specified by the Buyer. If the Seller does not have a replacement product, he has to refund money paid for the items to the Buyer. The money is refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received Buyer's notification with a wish to exercise this right, and if the products are not returned to the Seller, 14 days term specified in this clause is calculated from the day when Seller receives the products.
2.4 By accepting this Policy, the Buyer agrees that the money would be returned to the Buyer's bank account, unless otherwise agreed between the Buyer and the Seller.
3. Exchange and return policy for faulty product
3.1. Defects of sold products are eliminated, faulty products are replaced and returned in accordance with the procedure established in the Policy and the requirements of legal acts of the Republic of Lithuania.
3.2. If the Buyer has bought faulty products of inadequate quality or with a failure to comply with the manufacturer's specifications, the Buyer may return products and at his own choice require:
3.2.1. that the Seller, within a reasonable time, would eliminate defects in the product, if it is possible;
3.2.2. to reduce the purchase price accordingly;
3.2.3. to replace the product with an analogous quality product, unless the defects are minor or they appeared due to Buyer's fault;
3.2.4. to refund the price paid and declare a withdraw from the purchase and sale agreement, when the sale of a faulty product is a material breach of the order.
3.3. The Buyer may choose only one of the remedies provided in clause 3.2. The Buyer must make his choice when returning the product to the Seller. If the Seller is not able to fulfill the provided remedy in clause 3.2, the Seller shall offer an alternative option from the clause 3.2. The Buyer has no right to change the chosen remedy. The buyer has no right to declare a withdraw from the purchase and sale agreement if the product's defect is minor.
3.4. The following conditions must be met in order for the buyer to return the products:
3.4.1. to notify Seller by email firstname.lastname@example.org. The message must specify the products to be returned to the Seller;
3.4.2. to submit the purchase order, proof of guarantee (if issued);
3.4.3. submit a free-form request.
3.5. The Buyer may exercise the right to return faulty products within the term of its quality guarantee specified in the purchase document.
3.6. The money has to be refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notice about the faulty product, and if the Buyer has not returned products to the Seller, the term specified in this clause shall be counted from the day of returning the products to the Seller. By accepting these terms, the Buyer agrees that money would be returned to the Buyer's bank account, unless otherwise agreed between the Buyer and the Seller.
3.7. No refund for products that have been intentionally or negligently damaged (exposed to chemicals, water, open fire, high temperature, sharp objects, etc.), or if the rules for the use or storage of products have been violated or the products have been misused.
3.8. Separate rules for the return of faulty products may be proposed by the Seller and provided in the warranty documentation accompanying them. Such separate rules proposed by the Seller shall be applied so much as not to conflict with these Terms. In the event of any mismatch between these Terms and the rules proposed by the Seller, these Terms shall prevail.
4. Product and money return policy
4.1. The Buyer shall apply directly to the Seller for the return of products purchased from the Seller.
4.2. The Buyer may exercise the right of product return only if the term for returning the products has not expired. Returns are subject to additional requirements if products are being returned in the cases set forth in 1st and 2nd clauses: the product has not been damaged or its appearance significantly changed, and the product has not been used - all returned products must be accompanied by authentic labels, protective bags and original packaging.
4.3. When returning the products, the Buyer must indicate the address of the sender and the recipient and pack the product properly so that it would not be damaged during shipment. The Seller from whom the Buyer has purchased the product has the right not to refund defective products. The Seller shall not be responsible for improperly packed parcels sent by the Buyer, incorrectly specified address, or if the parcels have been lost or damaged upon return to the Seller.
4.4. If the Buyer has purchased a set of products, he must return the full set of products, i.e. the Buyer may only exercise the rights of the product return only with respect to all products included in the set.
4.5. The Buyer shall fulfill all the requirements for the product return and follow the procedure set forth in this Policy.
4.6. The Buyer may return the products by courier or direct delivery to the address specified by the Seller. The Buyer shall separately agree with the Seller on the procedure and conditions for delivery of heavy goods (to assess the quality, change, repair or return the products) by telephone or email email@example.com.
4.7. If the Buyer has exercised the rights set forth in this Policy, the money shall be returned to him within 14 (fourteen) calendar days from the date of returning the product to the Seller.
4.8. By accepting these Terms, the Buyer agrees that the money would be returned to the Buyer's bank account, unless otherwise agreed between the Buyer and the Seller.
4.9. Exercising the rights set forth in 1st and 2nd clauses of the Policy, the Buyer shall be refunded the product price. Shipping cost are non-refundable. Exercising the rights established in 3rd clause of the Policy, the Buyer shall be refunded: the product price, the shipping cost of the product. The cost of product return is not reimbursed.
4.10. If the Buyer has chosen another delivery method than the one offered by the Seller, the additional cost of delivery method shall be non-refundable.
4.11. The Seller has a right not to refund the amount paid by the Buyer until transferred products have been verified by the Seller for compliance with clause 4.2 of the Policy.
